This Adoption Agreement (“Agreement”) is made between the Rescue and the Adopter in respect of the dog described above. By signing this Agreement the Adopter confirms that they have read, understood and agree to be bound by every term below. 1. OWNERSHIP & LEGAL TITLE • Legal ownership of the dog remains with Safe Space Canines until the full adoption fee is paid AND the dog is neutered in accordance with the separate Neutering Agreement. • The Adopter has custody and care of the dog but does not become the legal owner until both conditions are fully satisfied. • The Adopter may not sell, rehome, give away, loan, board, or transfer the dog to any third party without the prior written consent of Safe Space Canines. • Any purported transfer of the dog in breach of this Agreement is void as against the Rescue. Survival of obligations: The obligations set out in Clauses 4 (Lifetime Contact), 7 (Lifetime Backup), 8 (Payment & Non-Refundability), 10 (Breeding Prohibition), 11 (Additional Protections – insofar as they relate to insurance, liability, no rehoming, identification, travel, end of life and alterations), and any other clause expressed to survive, shall continue in full force and effect for the lifetime of the dog even after legal ownership has transferred to the Adopter. 2. MICROCHIPPING • The dog is microchipped in compliance with the Microchipping of Dogs (England) Regulations 2015 or the Microchipping of Dogs (Scotland) Regulations 2010 (as applicable). Where the database permits, the Rescue may retain a secondary/contact entry. • Once all conditions for ownership transfer are met, the Adopter shall transfer the microchip into their sole name within 14 days and provide confirmation to the Rescue. Failure to do so is a material breach. 3. CARE STANDARDS The Adopter agrees to provide at all times: • Safe, warm shelter inside the home — the dog shall not be kept outdoors permanently; • Nutritious food, fresh water, and regular exercise appropriate to age, breed and individual needs; • Annual vaccinations, regular flea & worm treatment, and prompt veterinary care when needed; • A secure garden/escape-proof area and proper control in public places; • Not to chain, tether, or keep the dog confined inappropriately; • Full compliance with the Animal Welfare Act 2006 (England & Wales) or the Animal Health and Welfare (Scotland) Act 2006 (as applicable), including the animal’s five welfare needs. 4. LIFETIME CONTACT & UPDATES For the entire lifetime of the dog (including after ownership has transferred), the Adopter agrees to: • Maintain reasonable contact with Safe Space Canines and provide updates, photographs and news as reasonably requested; • Respond promptly to messages, calls or emails from the Rescue; • Inform the Rescue immediately of any change of address, contact details, or significant change in the dog’s health status. This obligation applies for the dog’s lifetime — even after full payment, neutering and transfer of legal ownership. 5. WELFARE CHECKS • During the first 12 months from the date of this Agreement, the Rescue may conduct welfare checks. Visits may be unannounced only with the Adopter’s prior consent. Otherwise, visits will be arranged at a mutually agreed time between 09:00 and 17:00, seven days a week. • After the first 12 months the Rescue may still request a welfare check if it has reasonable grounds for concern about the dog’s welfare. The Adopter shall not unreasonably withhold consent to a mutually convenient visit. • If the Rescue finds evidence of mistreatment, neglect, unsuitable living conditions, or a material breach of care standards, the Rescue is entitled to recover possession of the dog through lawful means (including court order). • No refund of any adoption fees or payments will be made in the event of recovery. • The Adopter shall be liable for all actual, reasonable costs incurred by the Rescue including (but not limited to) veterinary fees, transport, temporary care, behaviour assessments and legal expenses. These costs represent a genuine pre-estimate of the Rescue’s losses arising from breach and may be claimed up to a maximum of £3,000. 6. TEMPERAMENT & RISK ACKNOWLEDGEMENT • The Rescue cannot guarantee or confirm absolutely that the dog is not aggressive in all circumstances. Information provided about temperament is honest and accurate to the best of the Rescue’s knowledge at the time of adoption. • Videos and evidence of the dog around other animals and people can be provided upon request. • With other dogs/animals: If the dog is known to have issues with other animals, this will be disclosed to the Adopter prior to adoption. • With children: Unless explicitly stated otherwise in writing, the Rescue does not recommend this dog for a home with children. The Adopter accepts full responsibility and liability for the dog’s behaviour around children and any interactions that occur. 7. LIFETIME BACKUP — MANDATORY RETURN If at any time in the dog’s life the Adopter can no longer keep the dog — for any reason — the Adopter MUST first offer the dog back to Safe Space Canines. The dog shall not be placed in any other home, shelter, rescue or with any third party without the Rescue’s prior written consent. The Rescue will always take the dog back (subject to capacity; if the Rescue cannot immediately accommodate the dog it will work with the Adopter to find a temporary solution while arrangements are made). This obligation survives the transfer of legal ownership and applies for the lifetime of the dog. England • Scotland • Wales Page 2 Version 2026-08 (Revised) Safe Space Canines – Adoption Agreement Confidential No refund of the adoption fee, any deposit, or any other payments shall be due or payable upon return of the dog under this Clause, or for any other reason whatsoever. 8. PAYMENT, NEUTERING & NON-REFUNDABILITY — OWNERSHIP RETENTION • Until the adoption fee is paid in full AND the dog is neutered in accordance with the separate Neutering Agreement, legal ownership of the dog remains with Safe Space Canines. • If the dog is not neutered by the agreed deadline — even if the adoption fee has been paid in full — the Adopter must return the dog to Safe Space Canines. No portion of the adoption fee or any deposit will be refunded. • If a balance remains outstanding, the Adopter agrees to make payments as arranged. Until fully paid, ownership remains with the Rescue. • In the event of missed payments or non-payment, the Rescue has the right to recover the dog through lawful legal channels and no fees paid will be refunded. • The adoption fee and any deposit are strictly non-refundable in all circumstances. This includes (without limitation): return of the dog under Clause 7 (Lifetime Backup) for any reason (including that the dog requires more training than expected); recovery of the dog for breach or any other reason; failure to neuter; non-payment; or any other breach of this Agreement. No portion of any fees paid will ever be refunded under any circumstances. 9. REPOSSESSION & ENFORCEMENT • In the event of any breach of this Agreement, the Rescue (while it remains legal owner) is entitled to recover possession of the dog. • After ownership has transferred, the Rescue may still seek an order for return of the dog and/or damages by enforcing the contractual obligations that survive transfer (see Clause 1). • The Adopter agrees to voluntarily return the dog upon written request from the Rescue. • If voluntary return is refused, the Rescue shall enforce its rights through the appropriate court process: – England & Wales: Small Claims Track / County Court – Scotland: Sheriff Court (Summary Cause or Simple Procedure as applicable) • Nothing in this Agreement authorises the Rescue to enter private property without permission or to take the dog without lawful authority or a court order. 10. BREEDING PROHIBITION The Adopter agrees not to breed from this dog under any circumstances. If the dog is mated or becomes pregnant: • The Rescue has the immediate right to request the return of the dog and to enforce this through the courts if needed; • Spay / termination of pregnancy may be arranged at the Adopter’s cost once the dog is returned to the Rescue; • All puppies born become the property of Safe Space Canines; • No fees will be refunded and the Adopter may be liable for all costs incurred. This prohibition survives the transfer of legal ownership. 11. ADDITIONAL PROTECTIONS — RESCUE & DOG A. Veterinary Consent & Emergency Care • Until legal ownership transfers, the Rescue must be consulted before any major veterinary treatment, surgery or procedures are authorised (except as below). • In a life-threatening emergency where the Adopter cannot reach the Rescue in time to obtain consent, the Adopter may authorise necessary emergency care but must notify the Rescue within 24 hours and provide full details and receipts. • The Rescue retains the right to approve or decline non-emergency veterinary treatment and will be consulted on all long-term medication or ongoing health plans while it remains legal owner. B. Insurance & Liability • The Adopter agrees to maintain suitable public liability insurance for the dog throughout the period of care (and after ownership transfers, for so long as the dog remains in the Adopter’s care). • The Adopter accepts full legal liability for all injury, damage or loss caused by the dog while in their custody. The Rescue is not liable for any incidents occurring while the dog is in the Adopter’s care, even where ownership has not England • Scotland • Wales Page 3 Version 2026-08 (Revised) Safe Space Canines – Adoption Agreement Confidential yet transferred. • Until ownership is fully transferred, the Adopter shall name Safe Space Canines as an interested party on any pet insurance policy for the dog. C. No Rehoming / No Transfer • The Adopter shall not sell, give away, loan, board or surrender the dog to any third party, rescue, shelter or authority without the Rescue’s prior written consent. • If the Adopter is hospitalised, imprisoned, or otherwise unable to care for the dog, the dog must be returned to Safe Space Canines — not to family, friends or local authorities — unless the Rescue gives prior written consent to an alternative temporary arrangement. D. Identification & Travel • The dog must wear a collar and tag bearing the Adopter’s name and address in public as required by law. Until ownership transfers, the Rescue’s contact details must also be included or kept on file. • The dog shall not be taken outside the United Kingdom without the Rescue’s prior written consent. This includes holidays, travel or relocation. This restriction survives ownership transfer. E. End of Life / Deceased Dog • In the event of the dog’s passing, the Adopter must notify the Rescue within 48 hours and provide confirmation from a veterinary surgeon or independent witness. • Until ownership is fully transferred, the Rescue must be consulted regarding burial or cremation arrangements and retains the right to request the return of the dog’s body for burial or cremation at the Rescue’s discretion. • Any legacy or donation left in the dog’s name shall, where legally possible, be gifted to Safe Space Canines. F. Alterations & Surgery • No cosmetic alterations — including ear cropping, tail docking, dewclaw removal or teeth filing — shall be performed on the dog for any reason. • No elective procedures or non-essential surgery may be carried out without the Rescue’s prior written consent while the Rescue remains legal owner. After ownership transfers, the Adopter remains responsible for ensuring any procedure complies with applicable animal welfare law. 12. BREACH OF AGREEMENT If the Adopter fails to comply with any term — including (without limitation) refusal to provide updates or respond to contact requests, rehoming without consent, non-payment, failure to neuter, poor care, breeding, refusal to allow reasonable welfare checks, unauthorised veterinary treatment, or unapproved travel — the Rescue may: • Request the return of the dog and enforce this through the courts; • Retain all fees paid (the adoption fee and any deposit are non-refundable); • Claim reasonable costs up to £3,000 as outlined in Clause 5; • Take legal action to recover costs or losses; • Report animal welfare concerns to the appropriate authorities. 13. GOVERNING LAW & JURISDICTION This Agreement is governed by the law of England and Wales. Where the Adopter resides in Scotland, the Rescue may elect to enforce its rights under Scots law before the Sheriff Court. Nothing in this clause overrides any mandatory consumer protection rules that apply in the Adopter’s place of residence, nor does it purport to exclude the proper legal channels applicable to the Adopter’s location. The Rescue will always act lawfully. 14. NOTICES Any written request, notice, consent or communication under this Agreement may be given: • by email to the email addresses stated in this Agreement (or any updated address notified in writing), and shall be deemed received on the next working day after sending; or • by recorded delivery post to the postal addresses stated in this Agreement (or any updated address notified in writing), and shall be deemed received two working days after posting. The Adopter must keep the Rescue informed of any change of email or postal address. 15. DATA PROTECTION England • Scotland • Wales Page 4 Version 2026-08 (Revised) Safe Space Canines – Adoption Agreement Confidential The Rescue will process the Adopter’s personal data only for the purposes of administering this adoption, monitoring the dog’s welfare, enforcing this Agreement, and complying with legal obligations. Processing will be carried out in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The Adopter may request a copy of the Rescue’s privacy notice at any time. The Adopter consents to the Rescue retaining contact details for the lifetime of the dog for the purposes set out in this Agreement. 16. CAPACITY & WARRANTIES OF THE ADOPTER The Adopter warrants and confirms that: • they are aged 18 years or over and have full legal capacity to enter this Agreement; • if the Adopter rents their home, they have obtained (or will obtain before the dog arrives) any necessary written permission from their landlord or housing provider; • all information provided to Safe Space Canines during the adoption process is true, accurate and complete; • providing false or misleading information may be grounds for immediate recovery of the dog and termination of this Agreement. 17. SEVERABILITY If any provision of this Agreement is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from this Agreement. The remaining provisions shall continue in full force and effect. 18. ENTIRE AGREEMENT This Agreement (together with the separate Neutering Agreement and any fee schedule or payment plan agreed in writing) constitutes the entire agreement between the parties in relation to the adoption of the dog and supersedes all prior discussions, representations and agreements. No variation of this Agreement shall be valid unless made in writing and signed by or on behalf of both parties. 19. ASSIGNMENT & CONTINUITY The Rescue may assign or transfer its rights and obligations under this Agreement to another bona fide animal welfare organisation in the event that Safe Space Canines ceases to operate, changes its structure, or considers assignment to be in the best interests of the dog. The Adopter’s obligations shall continue for the benefit of any such assignee. The Adopter may not assign their rights or obligations under this Agreement without the prior written consent of the Rescue.
